PROFILE:
Mr.Selimi completed his Articles with the law firm Maddock Lonie & Chisholm. Upon admission to practice in 1990, he practised as a solicitor for 5 years with Mulcahy Mendelson & Round gaining a wide range of experience in general commercial litigation and crime.
During his time as a solicitor, Mr. Selimi appeared as a "solicitor advocate" in most of his cases including interlocutory applications and trials in the Magistrates', County, Supreme and Federal Courts.
A particular highlight of his experience as a solicitor advocate was his successful appearance in the Full Court of the Supreme Court of Victoria in the leading defamation case of Hercules v Phease & Lah [1994] 2 V. R. 411 (following his successful appearance in the County Court where the plea of 'absolute privilege' was upheld at first instance).
Upon joining the Bar, Mr.Selimi was the last pupil to have read with Mr Philip Dunn Q.C. Since signing the Roll of Counsel, Counsel has practised predominantly in the field of general commercial litigation in the County, Supreme and Federal Courts and has also appeared in several criminal trials in the Magistrates and County Courts.
Counsel's practice includes the provision of advice on the likely prospects of success of proposed litigation; drawing all necessary pleadings; appearances in the Practice Court in respect of all interlocutory applications (with particular experience in applications for interlocutory injunctions and preliminary discovery); appearance as Counsel at mediations and Case Conferences, and (last but not least!) appearances at trial. At trial, Counsel particularly enjoys the cross - examination of witnesses and the delivery of opening and closing addresses.
Although Mr. Selimi predominantly practices in commercial matters, he also appears in contested property disputes in the Family Court and property disputes in de facto relationship cases.
In addition, Counsel has a passion for appearing as a jury advocate in contested criminal matters in the County Court; enjoys plea making (the 'fewer the merrier' unless he did not appear at the contested hearing!); and also appears as an appellate advocate in the Court of Criminal Appeal (recently appeared successfully for the accused Appellant in the Victorian Court of Criminal Appeal in R v. Akgul [2002] VSCA 222 20 December (2002).
More recently, Counsel has developed a particular interest and specialty in securities malpractice since his successful appearance as sole Counsel for the Plaintiff (during the last 5 months of a 7 month trial) in the Supreme Court of Victoria before Justice Smith in the highly publicised landmark case of Rahmat Ali v. Hartley Poynton Ltd: see [2000] VSC 113 No.1 (16 April 2002);(No 20 [2002] VSC 245 (21 June 2002); (No 3) [2002] VSC 292 (26 July 2002).
In the field of securities malpractice, Mr. Selimi predominantly acts on behalf of investors who have lost money at the hands of negligent stockbrokers and financial advisers.
