1. Practises in large scale litigation and arbitration of:
(a) construction and engineering disputes; and
(b) product liability disputes
(c) professional negligence - in particular, construction related professionals.
2. Practice includes both advice to clients on claims and disputes prior to litigation or arbitration, and the conduct of and appearance at trial in litigation and arbitral proceedings.
3. Example cases in which Counsel has appeared over recent years include:
(a) BHP Billiton Olympic Dam Corporation Pty Ltd v. Steuler Industriewerke GmbH - 2008 trial before Justice Habersberger concerning the HDPE lining material installed at the BHP copper and uranium mine, Hydromet Plant;
(b) Southern Suburban Railway Project in Perth - 2008 - acting for a major subcontractor in relation to disputes with the main contractor concerning the rail project;
(c) KT Pty Ltd v. Powerco Energy Services Pty Ltd - 2007 arbitration concerning gas piping project in Tasmania;
(d) Denton Corker Marshall Pty Ltd v. Australian Super Developments Pty Ltd - 2005-2006 arbitration concerning The Herald & Weekly Times building in Flinders Street, Melbourne;
(e) TNT Australia Pty Ltd v. CMW Design & Construct Pty Ltd & Ors. - 2005 & 2006 Supreme Court proceeding concerning the TNT Laverton Airport project;
(f) Abigroup Contractors Pty Ltd v. 620 Collins Street Pty Ltd - 2005 - arbitration concerning residential high rise development at 620 Collins Street, Melbourne;
(g) Grocon v. The MCC - 2005 - Supreme Court proceedings concerning the MCG project.
